In defence of 120b ipc

In a corruption related case, the whole investigation has proceeded with intention to protect real culprits and in their place rope in some innocents.

Despite of providing all supportive documents that there is no criminal conspiracy amongst the all accused, while framing charges ithe judge noted:

"The evidence on criminal conspiracy is rarely direct and can be infererd from the surrounding circumstances and conduct of the accused persons. The entire background and circumstances reflected in the chargesheet bring out the role of the accused persons and at this stage prima facie it appears that the accesed persons committed the offences in execution of their common design even if such offences were ultimately committed by some of them, without the participation of others".


I am need of supportive material in defence of the above statement. Pls. help.
