you can file a case against the bank for deficiency of service.you must also lodge a FIR mentioning the whole facts. this definitely attracts 405, 406 .420 120B IPC. take the help of a lawyer .do not make delay in lodging FIR.both cases can be done at the same time.

Banking Ombudsman is rather a quick remedy.......it acts under the guidelines of RBI.

U need to submit detailed complaint to the concerned bank manager with a copy to Nodal Officer at H.O. Simultaneously file RTI application if the bank is a govt bank and obtain photocopies of all withdrawals and specimen signature card. After 30 days of complaint, move banking ombudsman of the state where the fraud has occured. U can get details of Nodal Officer by visiting website of the bank and RBI for ombudsman. Details of RTI are in my files posted on this website under central govt information.
