Judges has to be appointed by way of all-india exams like IAS, IPS. Say IJS - Indian Judicial Services - so that all Judges will be appointed on merrit and this panel/collegium will coordinate that. This will solve all these problems and aam aadmi's wil not suffer..
Why article 312 (a) is not implemented yet? Even though this article is amended around 40 years back...
