Dear Veena

first explain where are you situated?

ajay sethi (lawyer)     17 October 2011

issue legal notice . what are the clauses in your agreement if tenant fails to vacate the premises? does it provide that he will be liable to pay penal rent .

you will have to after legal notice proceed legally against him for recovery of your flat . do not return the security deposit retained by you .

issue a legal notice first and then file for eviction and damages.

First file caveat petition before court having original jurisdictioin and next give leal notice determing the tanency  under SEc 106 T.P Act. Then file suit of ejectment and damages
