Wife filed for divorce on ground of impotency, and husband filed for RCR denying all those allegations. Now, after getting potency test result in his favour, can husband use HMA 23A to ask for divorce on ground of mental cruelty which arises out of impotency allegation as alternate relief? If yes, should he ask for it as part of RCR or counter filed for her divorce petition?
