It is about a plot of village natham property measuring about 4 cents. The property is located close to my ancestral house located in a village in Tamil Nadu. In the plot, my late grandfather, his late brother and three of their relatives built what is called SER PATTARAI (KALANJIAM) for storing food grains. There were five sections in the structure being used by five families.
Section 1 (belonging to my late grandfather's brother): He wrote a will in 1938 and gifted his part to his late wife. They did not have any children. The will was duly registered.
Section 2 (belonging to late grandfather's late sister's son): There is no document available about this part with descendants of this family. However, in the will executed by my late grandfather's brother, he clearly mentions that his SER is located to the east of his sister's son.
Section 3 (belonging to a close relative ie PANGALI): The PANGALI is no more. His descendants had executed a partition in 2010 in which they mention the size of the plot and they mention that one fifth of the plot belongs to them. The partition paper was duly registered by the family. The partition also mentions that their part is in the middle of the structure.
Section 4: My grandfather's portion --- My late father and his late brother executed a partition document in 1954 in the presence of village elders. The document mentions that one part of the SER belongs to my late uncle. My late uncle did not have any children. Their partition document was not registered.
Section 5 ( A close relative ie PANGALI): In the partition deed carried out in 1963, the fifth part was named in favour of my late Periyamma's son. The partition deed also was duly registered. The partition deed names the other owners of the ser pattarai.
Over a period of time, the structure had collapsed and a government surveyor had written the plot as government land.
Now our family would like to reclaim our parts as descendants to two parts. The descendants of the other three parties would like to give their portion for a price to us.
How do we get patta for the whole plot in our family name ?
