How to alter name on marrige certificate.

Hi All,

 

Can Anyone suggest me if I can change name on marrige certificate after one year of receiving it. Currently I am getting my marrige certificate made with my maiden name for dependent Visa but after coming back to India I want to again get it changed with my Husband 's surname.Would it be possible?

  1. Engage a advocate whenever such changes are being done. An advocate can be found via reference.
  2. When the marriage certificate is being Typed / prepared by the official of the Registrar office usually a draft copy is shown to the parties to check for any typographic mistake, at that time correction can be done and not afterwards (means once it is issued).
  3. Here facts say you already received a Marriage Certificate 1 year ago. In same breadth you are telling us you are getting made one Marriage Certificate with your maiden name for dependent Visa. Lastly you are talking that once you come back home you will like to change name as in Marriage Certificate again. Tell us then what is the value of first that was made 1 year ago and this new Marriage Certificate left to and ancillary documents (if any; PAN / Voter ID card / Adhar Card / State Tel. / Driving License / Scheduled Bank AC title / Property title / Passport etc.) not tallying and running again and again for few more changes?
  4. In my opinion change in name spelling / wrong mention of surname etc. can be changed via filing an Affidavit r/w attested copy of Passport / Election Card / Adhar Card) in a Marriage Certificate of that long issue not such frequent changes on whims and fancies of party.
  5. Also it is not binding as per Law to change maiden name after marriage it is left on fancy of bride to change or not to change to husband's surname.
  6. Dependent Visa can be got with previous Marriage Certificate which you tell us is one year old if it has maiden name or even if it has surname of husband then also ancillary documents proves your actual name before concerned Embassy and issue of dependent Visa is not struck anyway.

Hi ,

Thanks for your reply but I have not made my marrige certificate made as of now ,but wanted to get it made with my Husbands surname ,but due to shortage of time I am getting it made with my Maiden name as I have my maiden name on all other documents such as Passport ,PAN card and changing the name on all these documents will take atleast 2-3 months which I do not have thats why I am planning to make my marriage certificate with my maiden name.All that I wanted to know is whether I will be able to change my maiden name in marrige certificate with my Huysband's surname after comning back to India.

I read above sentence as you already have marriage certificate, apologies for misreading a query assure may not happen again.

Nevertheless a lady acquires 'surname' of husband only after marriage. Now your query tells marriage already performed so at this juncture you have two choices which I already mentioned before and repeating again; you have option to retain maiden name or second option is to adopt surname of husband for the purpose of "marriage certificate' making in reference to your query. 

But what you are asking now is clear to me; you are saying right now due to shortage of time you want to get marriage certificate with maiden name and travel overseas and sometime in future once you have time you and when you come back you will like the previous issued marriage certificate to change - get corrected with surname of husband - right !. 

To above I say it is not possible so far as marriage certificate once issued with whatever given name then after it is proof read for any correction and once issued only technical spelling mistakes are changed and not whole texture. 

However remedy for you then once you come back would be to get Gazette Notification done along with national newspaper advertisements of name change from maiden name to surname of husband and pick one too many copies of Gazette Publications and annex in various Public Documents (PAN / Voter ID Card .....etc. refer partial list in my previous reply) and including Passport fill up respective Public Departments Forms and everywhere in users Publci Documents name will then appear with husband's surname. 

Above is correct legal procedure. Now refer to old post of mine for Format of Name Change for Major (Gazette Publication purposes) and download the format from one of my old reply and once you come back to India apply for change of name in all your public documents except marriage certificate which is only way out allowed in reference to context.

It is a procedural matter. It can be made in sub registrar office.  Meet directly registrar. He will guide you.
