How much will take divorce in family Court

Dear Sirs,

I have filed divorce petetion in jan 2010, last month my evidence produre complited, her side evidence was pending, for our surprise she brought stay on divorce case proceedings from High Court (In stay she is asking for case transfer to Belgaum Family Court), I have some queries, please help me.

1) Why she is asking case transfer to Family Court? (That too after 1Yr 6 Months)

2) Will again case will start from scratch in Family Court?

3) Usually how much time will take for Divorce Case (To get decree) in Family Court.

Yur first que. is interesting.

1. She may be asking due to in-convenience to attend the case before instituted Jurisdiction. However if from past 1 year plus if she and or her side attended the case in instituted jurisdiction then I feel her belated transfer plea Application may get rejected and that is strong point in your favour.

2. Yes it will start from reconciliation efforts gain at transferred FC followed by evidences and so on so forth.

3. Normal is 2 years on average if both sides are regular in Court attendance..
