How far is it true that..........?????

How far is it true that  Husband can get bail from Allahabad High Court without going jail under sec. 498 (A) as claimed by my lawyer.

So far my knowledge is concerned, it's a non bailable and husband has to stay at least one day in jail to get the bail.

Dear Ganesha,

Unless and until the husband is arrested, he can move an application for anticipatory bail either in Sessions court or High court.  

You shoudl first avail ur remedy before Sessions court.

Your lawyer is right. It is called stay on arrest in UP.
