How can i file case if a person is absconding for nonpayment

As per an unregistered agreement signed between me and another person in January 2008. He has to pay me a sum of rupees ----- on selling of his land. Now he has sold the land and went absconding. Im not paid the amount. I tried all possible ways to search him. But he is not traceable.

My advocate says that any agreement is valid only for 3 years. I had not mentioned any time frame in that agreement. its already 2 years and 6 months now.

How to trace this person legally...??? How can i move legally to get my amount back...???

You can file a case. Get an Exparte Decree against the person. In this way you get another 12 years for executing the decree and within that period you trace that person and execute the decree to recover the amounts.
