If he has been allocated with a separate parking space then using the common parking space may not be legally maintainable, the society can initiate action as per bylaws.

He can't use common parking.

He can be allowed to park in the common area subject to the following.

  1. Under the byelaws of the Society cars are allowed to be parked in the common parking area on payment of prescribed parking fees.
  2. After satisfying the requirement of other members, vacant parking lots are available.
  3. The member is already parking one car in his own parking lot and this is his requirement for a second car.
  4. After a parking lot is allotted to the member, if another member having only one car wants a parking lot and no vacant lots are available, the member should vacate the plot in favour of the other member.
  5. The General Body can fix a higher fees for a second car.

The general attitude should be to help members without any feeling of envy.
