Hit and run car accident - ipcs

Hello,

There was a car that hit our car that was parked legally (while he was trying to park his car in front of our car). The driver left the place without giving us any details but we tracked him and found who the owner was. The owner initially agreed to pay for the repair and few months later is not picking up the phone...

Now, I am looking at the possibility of filing a criminal complaint and need to know:

1. What are the IPCs applicable to such an incident? Any cognizable sections?

2. Are there other Acts that will make this act of the hit and run a criminal offence?

No cognizable sections, as you said matter is very old now.

 

Did you lodge any complaint at that time?

The matter is few months old but there are no time bar on criminal complaints (to the best of my knowledge). I didn't lodge a complaint at that time but have now...

How could it be that someone can damage your property to the tune of more than 10K and run away? Can we go and break a house or another car causing heavy damage to it and the police can't do anything?

There is time imitation for all criminal complaints too. Refer S 468 of CrPC.
