Help

Under section 18 of the Evidence act : persons who are not parties on record but who are interested in the subject matter of the suit are considered by the law as real parties in interest and accordingly their admission have the same weight as though they were parties on the record.

Ques: If the admission of the interested person constitute an offence will the same court punish the interested party in the same case?

Family Members of defendant voluntarily and without any notice from the court appeared in the court in Execution case u/s 125 CrPC and furnished False Statements about the whereabouts of defendant in the Family Court.

There is Conclusive Evidence placed before the Family court about the Falsehood of all the Family Members of the defendant.

Can the family members be treated as parties in interest on the issue of finding the whereabouts of the defendant u/s 18 of Evidence Act where it is mentioned that " Under section 18 of the Evidence act : persons who are not parties on record but who are interested in the subject matter of the suit are considered by the law as real parties in interest and accordingly their admission have the same weight as though they were parties on the record.

Can all the family members be punished by family court U/s 10(2) & 10 (3) of family court act read with Sec 179 Crpc or any other provision of CrPC.?

Can the family court punish all the family members of the defendant for the commission of other offences which are not under the purview of sec 195 CrPC?
