Harrasement by an outsider in co-op hsg soc

There is a person in our housing society who is harrasing us and above all he is not even an member of our society. We have already filed a complaint with our society but they are hesistant to take action as he is active member of Maharashtra Navnirman Sena. Today he has threatened my entire family in front of police officials and they also failed to act upon it. This person is staying in his friends house who is an member of our society but there is no relation between them. Is there any legal provision under co-operative housing society's act which enables us to file a writ against this person and our society. Our basic concern is vacating him from our society.

Law is not a remedy for every ill in the society.

Inform Raj Thakray that his purported MNS person is creating public nuisance,failing which call police and media to make it a bigger issue to nip the nuisance in the bud.

Be bold to protect your rights.

Law and God does not help weaker.

It would be good if you sit and talk with some good local criminal advocate before writing a complaint and take his guidance. If the threats are of serious nature like threatening life etc. then you may write a complaint on a piece of paper, make its photocopy. Submit it to the local police station and get the photocopy stamped and signed by the recieving police officer. If they refuse to take the complain then send complaint by registered letter with A/D to the local SHO with copy to the SP/Commissioner.


Also take sufficient self defense measures and precauations. The legal process is no substitute for self defense. Self defense is described from Sections 96 to 106 in Indian Penal Code. Remember RTI activist Shehela Masood is reported to have complained to the athourities about threat to her life, even to State IG and Home Minister but still she was killed as she did not take self defense measures and arm herself.
