Guidance mutation

Hi advocates

I would appreciate your assistantance on below

I have submited for mututaion change of name in municipal my name got changed however after couple of years they have cancelled my name and  restored to original owner with high handed manners

I have won declaration suit along with criminal charges against me

Note mututaion was cancelled because of documents issue stated they are not trust worthy and things

Civil and criminal cases won and got in favour of me (other connected cases)

Once municipal cancelled I have filled a civilsuit against them

Now the case is pending

Can i ask municipal to restore name?

Is that possible?

Quick Summary
This discussion concerns a user whose name mutation was cancelled by the municipality despite a subsequent court victory in a declaration suit and criminal charges. The cancellation was due to document issues, which have since been resolved in the user's favour. While a civil suit against the municipality regarding the cancellation is pending, the user seeks to know if their name can be restored. Advice suggests formally applying to the municipality with court judgments, mentioning the pending suit, and seeking a timeline, while also acknowledging the need to potentially wait for the court's final order.

Now as the case is pending in court your name can be restored only by court order.

You can definitely ask the municipal authorities to restore your name based on the favorable court judgments in your favor.

Since you've won the civil and criminal cases, and the mutation was cancelled due to document issues that are now resolved, it's reasonable to request them to reconsider. You may want to: -

*Submit a formal application*: Attach the court judgments and relevant documents to support your case.

- *Mention the pending civil suit*: Inform them that you have a case pending against the municipal authorities for cancelling the mutation and request expedited consideration.

- *Seek a clear timeline*: Ask for a specific timeline for resolution or a written response regarding your request. Be prepared for potential resistance and consider consulting your lawyer for further guidance.

Wait for court orders and, after receiving the court order, follow it as per the court's direction.

The municipal authorities will not entertain your request to change the name in the mutation records during the pendency of a civil case against them in this regard.

You may have to wait for the court's disposl after which you can take action accordingly.

Admittedly, the civil suit is pending. How are the other cases, which you have won, related to the issues in the civil suit?
