Ground for mental cruelty

 Dear All,

My sister got married in the year 2013, Whitin few months of marrirage her suffering started. Her husband had left the job before marrirage itself which was not communicated to us. He is not intersted to go to job or do any business. When we try speaking to him he uses all bad words. He has taken lot of money from my sister. One day sister saw a SMS were he had shared some personal information about first night and about her body to his brother-in-law is came back to us, Saying she will not stay with him. after seeing these messages she attempted suicide, Now she slowly turning normal. We want fille for divorce, Her husband is not agreeing for it.

 

Plz help with suggestion.

You had a similar thread a while back.

 

Anyways, If all mediation hs failed.

 

File the divorce. There is no additional case  he can file other than RCR or contest.

 

Court will grant divorce if prayer is presented properly. You may have go through the hoopla but not much delay expected..

Even if husband misses or uses delay tactic, you can win..

File a case based on desertion (2 years as per old thread), Lack of relationship which lead to cruelty.

Mental cruelty by one of the spouse is a certain ground for obtaining judicial seperation.But it has to be proved with valid available evidences.It depends on the  wisdom and expertise and sincerity of UR lawyer to make a strong case in her favour.

Hence take the able assistance of a local lawyer and proceed.

Try to first collect evidence against her husband. then file divorce on cruelty ground.

Hi Hema collect avidence and go for divorce not wait for any otjher accident happen in life i agree here with Rama chakar sir 

you contact with family lawyer and file case in court
