Gratuity issue

Dear Legal experts,

A person working in private medical college as professor, resigned and is on notice period for 3 months.

Service is of 10 years. Salary is without DA but basic is mentioned.

1. Is he eligible for Gratuity?

As nothing is mentioned in appointment order regarding Gratuity.

2. when he should apply for gratuity?

As employer has not given gratuity to other professor those who had resigned earlier.

3. Is there any specific format to apply for gratuity to employer?

Plz share the format or guide to make the application to apply for gratuity.

Teachers were made eligible for Gratuity with retrospective effect from 1997. If Payment of Gratuity Act applies to establishment, then gratuity is payable. The employee may submit FormI along with covering letter mentioning that notice of determination of Gratuity and payment has not been supplied...... If you ate unable to handle entrust to your Labor law consultant.

1. How we can make sure that payment of Gratuity Act applies to establishment?

Its a education Trust, management family runs the various Institute under this Trust.

2. From where i can get This Form I.

Both can be clarified/obtained from O/o ALC/DLC/Controlling Authority of Gratuity!
