Gratuity eligibility

Sir, I have completed 4 years 9 months with the company and i have resigned from over there. Now my question is that, is i am eligible to claim GRATUITY?..if yes can you provide any notification or judgment etc.

Date of Joining 02.02.2010

Last date of working 05.11.2014

 

Please reply i will be very thankfull to you.

My company HR personal says that i m not eligilble to claim Gratuity...anybody can help me out this..

Don't chat with HR. Submit FormI under proper acknowledgement or by Redg.Post.

As per Payment of Gratuity Act, 1972, any employees become elegible for the gratuity when he has completed five years service. The employee who has worked for 240 days in a year, then a year is treated complete year. Since the employee has completed four years and 240 days, he/she will be elegible for gratuity but after the completion of five years whether works for remaining period beyound 240 days or not.
