Gratuity

My former employer denied my grtiuity by saying that I am not eligible for the same as per the rules.

I have completed 4 Years and 239 days in the last year (including all holidays) in continues serrive. I use to have 2nd and 4th Saturday off now they are saying we are not fall under 5 days a week or 6 days a week so, only those days will be counted in the last year which are working apart from all holidays and weekly offs. They have consulted with a lawyer who has  given written statement of denying gratuity.

Can anybody guide me on this what stand should I take now? Should I leave my grauity? Am I really not eligible? Its a question of Rs. 65 K so I dont wanna loose such a bif sumt..please guide me.

Payment of Gratuity Act lays down 240days if establishment works for 240 days/week........ And 190 days if establishment works for less than 6 days/week. So you should be eligible.
