Gpa cancelled but still problems.

Hi Experts,

My father has given the GPA to his brother in 1964 and cancelled in 2005, Now his brother threatens that he will black mail him by making a Sale deed on old stamp paper and on previous date notary. So what will be the legal status, Can he do so even the GPA is cancelled. Thanks in advance.

Whether publid notice was published in local news papers about cancelling the GPOA?  Maintain all the correspondences and paper for filing complaint.  Secondly, back dated sale deed cannot be made since the GPOA holder has to first search for old stamp paper and if found, same cannot be registered since registration to be made within the time frame prescribed under the Indian Registration Act.  There can not be a sale by executing before Notary.  It requires compulsory registration.  Lodge the GPOA cancellation papers with all the concerned sub-registrars where the properties are situated.

even if the GPA cancellation is not published first take your local lawyer help to draft the notice and publish in the newspapers and for old stamp papers as explained above it has to be registered mere obtaining the old stamp papers will not give him the status it has to be registered in time frame and already 9 years passed
