Dear all experts,
I am residence of SRA flat in mumbai, the flat was in the name of my grand father & the property is alloted to us in the year 2012. now my grandfather wants to transfer the flat on my name. society is not registered yet, can i make gift deed & registered itself to transfer the flat on my name.
Please advise if any options

Dear Sir,
My Grandfather is the owner of th said flat, since the flat develope under the sra scheme, we can not execute the sale deed as per the sra rule for 10 years, perhaps we are in blood relatiotn, can we execute the gift deed?
But he can make Will , in case if he dies then flat should be transferred to you and it should be mentioned clearly you are residing in that flat .
There is some weak law point still this can be better trick .
Gift Deed means you are transfering SRA flat at this stage thus violating Free flat scheme
