Gift deed

A relative of mine and her daughter jointly own a flat in Navi Mumbai. My relative now wishes to gift her portion to her daughter. Is the Society's NOC required to initiate the preperation of the Gift Deed? The lawyer who they consulted says it is. Apart from that he maintains that this NOC must also mention that there are no dues owed to the society. But when I checked up with the Secretary of the Society - he ostensibly goes on to say that no NOC is required for making the Gift Deed & hence they would not issue! Please advise?

NOC IS REQUIRED.

NOC is require only when you where u transfer ownership. When transfer ownership society due must be clear by the transferror hence NOC from society is required from society.
