General power of attorney

Dear Sir,

 

We had a land of 2 grounds which was handed over to builders through GPA to promote to flats under JV. How ever the builder did not hand over the possesion of the flats as per the agreed terms and conditions. He had delayed the construction for more than 7 years and did not provide us the flats as per the agreed terms, we had cancelled the GPA issued to him.  The builders had sold their share of flats before the GPA was cancelled and realized the money.

After the GPA was cancelled, the builder has sold 4 more flats and transferred the UDS of the land to their name and had taken possesion of those flats.  Is the sale of flats valid after the GPA was cancelled? how can we retreive our property which is being misused.

 

Kindly suggest us the right path to get our property back. Thanks

it is not valid, file criminal complaint against the builder, simultaneously file suit for recovery of property, and you can ask for cancellation of sale deeds ,done by them after the cancellation of GPA.

Forget it and try some non-legal methods. you will not get your land back or any money from in builder as builder has already sold flats and ran away with your money.

The people who do not seek proper advice before transacting with builder get punished for their own wrong.

The builder's act is illegal, you can file a suit for cancellation of sale deed which was executed after cancellation of GPA as well as for recovery and possession of your property.  contact a laweyr and proceed with the case.

Sir,

We would like to know if the registrar of the concerned district have rights to make the Sale deed null and void, if we show the document evidence of cancelled deed of GPA.

He cannot do any thing, except to acknowledge the letter you forward.
