From what date is the period of limitation determined ? from payment date or disengagement date?

Dear all eminent lawyers,

 This is to continue the thread :-

My payment cheque was cleared on 18 / 6 / 22. The programmer sent an email on 10 / 08 / 22 that he will not do the project. 

This is the exact text of the email :- 

We have tried many times but we are not able to resolve the account section with avtar photo the issue so please you can hire another developer.  Now we are closed this project. 

Now my queries :- 

a) What is the period of limitation ?  Will it be from 18 / 6 / 22 or 10 / 8 / 22. 

b) Do I need to file a police complaint first before filing a legal suit ? 

c) Any other pertinent and relevant information would be greatly appreciated ?

The three years lmitation period will start from the date he declined to continue the project.

This is not a criminal offence hence the police may not entertain any complaint

Your time is getting closer hence you may better issue a legal notice to him and file a suit before 10.08.2025

Instead  of using different thread and mentioning reference of previous post vis-a-vis response  thereto, it would have been beneficial (for you) to continue same thread so that original facts, query and response could have been referred and obliged by experts who are utelising their experties at the cost of their professional engagements.
