Forced construction on plot

My mother in law owns a plot measuring 240sqyd at Rohtak since 1980. She transferred ownership of 50 sqyd to wife of her step son under some family agreement in 1990. However, the stepson and his wife illegally constructed a house on approx 135 sqyd. Rest of the plot is vacant barring some parking arrangement. when confronted they refused to vacate the land or compensate the owner in any other way. Due to being a family matter, it kept on dragging in meetings of family friends and relatives and even panchayat but no solution came out. Matter was not reported to police at the time of illegal occupation. Now the step son and his family refuses to let the owner occupy even the vacant part of plot and is resorting to violence whenever owner tries to occupy it. What is the course of action suggested to this 75 year old widow, mother of a soldier, posted on Shambha border. Regards

Dear,

 

File a suit for the demolition of the property and at the same time register an FIR for tress passing on your land and constructing the property and there are other relevant provisions which can be attributed in the present case.
