Filling Discharge for A1 in 498a/406

Dear Sir, I am roped into 498a/406. Final report is already been submitted by police. On next date charges has to be framed on me. The charges are already framed on my father. My lawyer suggests to go for discharge. Below are my findings and grounds for discharge: 1. Jusrisdiction ground: No incident has been mentioned for FIR registering location. 2. Malified investigation by police: In police station mother in law statement about harressing wife though mother expired prior to marriage. Another is IO lied in High court to cancel my AB which is on record. My question is should A 1 go for discharge on the basis of above two grounds. Though from FIR it seems that charges against me are triable and my father A2 is already has charges framed. My father didn't filed for discharge. Please suggest.

Yes, u should file discharge application for your father not for you, There may be other legal grounds also which you overlooked but your lawyer may point out. At first file a discharge application for your father only. For further assistance you may contact

For Discharge, each case is unique and depends on allegation.

check with your lawyer, only jurisdiction may help you.. not allegation, because they are matter of evidence and trial
