Filing mantenance case against wife

Dear Sir,

My wife has filed false dowry harassment case (498 A) and mantainance(DV Act 125) case against me and my family members. Due to the same the company forced me to resign from my jog (working in a private company).

Can i file a mantainance case against my wife and in-laws and also advise me other recourse(defamation and income tax notices, etc) to counter them. If so pls advise me the detailed sections.

Sir, Wife's are not required to maintain husbands .... Better contest your case on merits ....still if you have a strong proof of her being well financially you can seek maintenance in Hindu Marriage Act Section 24..... Warm Regards Kapil Chandna Advocate 9899011450

fight the case on merits. if you file defamation case now it will be considered as a retaliatory action and it will strenthen her 498a and dv.if she couldnt prove 498a against you then that itself would be a solid ground - cruelty on which you can claim divorce from your wife and she wont be entitled for any maintenance after divorce

once after the maintenance is awarded to your wife if you consider it to be excessive then you can file a modification petition in court to alter the maintenance amount

You first have to challenge all her cases and come out pure then only you have grounds for some action against her.
