Hello friends, just a query. Defendant is ordered to pay plaintiff fixed mesne profit by applying under order XX rule 12(1)(c) of C.P.C.
My lawyer has said the court proceedings for the partition suit should now be closed after compliance hearing has taken place and respective land holdings have been given possession of to all the 3 parties. After closing of this suit only can a seperate case for recovery of Mesne Profit be filed by the petitioner thats me.
Is this procedure correct?
Myself too wanted information about Mesne Profit .
99% I will win but issue is that other person is enjoying property and earning money.
I am not getting penny .
Under circumstance when I should ask for Mesne Profit. In Original Plaint Mesne Profit not mentioned because that time I was not thorough with law .
Can anyone refer or give article or write article about Mesne Profit and when and how it should be claimed . Under circumstances it should be claimed.
