Father died- how to partition

Hello respected sir,my father died in 1975.one home is on his name.he didnot write any bond/vill.wife is alive.we are 3 brothers and one sister.in 2 brothers and 1 sister want to partition.but 1 brother's family (this brother is died) is not agree with us. How to get partition immediately ? Can we separate the land for equal share without going to court ? Plz answer.thank you.

You can certainly decide the shares with mutual consent and execute a partition deed and get it registered.

Or file a partition suit in the court and the court shall order the partition as per the provisions of Hindu succession Act.

It is believed that you are all HIndu.

The proeprty is in which state?

Confirm!

Obtain death certificate, legal heir certificate and submit to the authrotiy under whose jurisdiction property falls to record inheritance and obtain latest mutation records (fard).

What is to be partitioned: house,land?

YOU CAN MESURE THE LAND AND DIVIDED EQUAL WITH EVERY CONSENT . OTERWISE  ANY OBJECTION ARISES

THEN 

YOU SUIT PARTTION TO COURT DIVIDED PROPERTY  FOR YOUR SHARE. COURT WILL DIVIDED EQUALY
