7years ago A 16yrs girl married to 20yrs boy. No evidence or proof (marriage photo, Invitation card, registered certificate) for their marriage. the marriage not registered yet. They have one boy baby aged 6yrs from their matrimonial life. Now the male who is now 27yrs seeking for divorce under cruelty. Kindly tell me what's the Proceduce to file this divorce

The Birth certificate of the child, the ration card, the pan card details, the nomination particulars registered with a Bank showing the relationship , the relationship shown in Voter and AADHAR are sufficient to establish a marriage.

Although the marriage at the age of girl of 16 years and boy of 20 year was illegal and voidable yet they opted to continue after attaining their marriageable age of 18/21 respectively, so the issue can not be agitated at this stage, which is not pressed.

The husband can seek divorce on the ground of cruelity depending upon facts and circumstances, which you did not disclose.
