False dowry case

Dear Moderator,

If the false dowry case is provided, can we:

01.  Apply for Divorce.  If so, should it take a long time.

02.  For the purpose of mutual consent divorce, can we initiate IPC sections for the false allegations made.

Please advise.

Yes, you can file divorce case, but it will take 5-7 yrs approx.

Both parties can together file MCD it will take 6months.

Dear Moderator,

Thanks for your immediate reply.

My apologies.... the case is filed under DV Act 2005 (under Section 12) only by the Peititioner for Maintenance and Police Protection in the Metropolitan Magistriate Court at Bangalore.  My requests are:

01.  How much time the case will normally run to pass orders by the Hon'ble Judge.

02.  If this case is proved to be based on false allegation and dismissed, can we file  a separate case at the Hon'ble High Court, Chennai under IPC 191 to bind or force the Petitioner to come for MCD.

03.  If you have any other IPC Sections in which the Petitioner can be filed case against to render justice and how much time, it will take.

No one can say how much time it will take maybe 7to10 yrs

No one can bound petitioner for MCD as it self explanatory MUTUAL CONCENT DIVORCE. 

There are several section in which you can file case if present case is based on false grounds. But it is very difficult to get any order against women
