Yup...that too from a judge, who just few days ago, denied regular bail. 

 

Classic case is mine where there are SC judgements where SC has clearly said passport cannot be taken away...yet courts and police continue to do it. Infact, one judge in HC is charging 20 lakhs as sutiety to release passports! What a country we live in.

@Q Slinger is absolutely right.  Despite supreme court ruling, the lower courts insist on passport seizure by police on the matrimonial disputes which is not only contrary to the settled laws but also against the fundamental rights too, but who cares.  There are many more such examples to prove ignorant and irrational behaviour of lower court judges who either do not know the law or have scant respect to law.  Especially the new and junior cadre judicial officers donot even bother to learn about what are provisions of law in the subject they deal with etc, so any amount of any  reforms undertaken in the top level, if the enforcement authority are reluctant, the desired results can never be achieved.

Very well articulated Kalaiselvan sir. 

 

Some of the judges I have seen and faced probably belong in a govt job cleaning toilets. Even  when they are quoted the law or judgements, they insist on following their own protocol. I bet sitting up high on the bench probably makes them feel like a king and hence don't have to hear from anyone else in this regards.

 

Our justice system is probably as pathetic as the ones in a third world countries or in Iran!! Nothing is consistent except for over zealousness and corruption.
