Experts: i am back with one more query.

There is a CRPC 125 case at JMFC court file by women.

 

Fact 1) Both the parties are married earlier.

 

Fact 2) Both the parties has divorce deed from their previous marriage.

 

Fact 3) Women is playing hide and seek.

 

Fact 4) On bench only one divorce deed has been placed and further a statement from women is taken that she does not have taken divorce from court.

 

Fact 5) Man has admitted he was married earlier. but he has not kept divorce deed on JMFC bench.

 

Fact 6) Man is me :)

 

Fact 7) Evidence from both side has been closed. Argument is to be done.

 

Question:

 

1) do I required to attend court date now?

till date of order you may attend if you consider it is required... else let lawyer attend.

you were supposed to attend the court only for ur evidence and cross.

for all other dates, presence of your lawyer was sufficient.

Though it is maintenance case, it is a criminal case, so there is no excuse from not attending the court, either you have to be present or your lawyer has to represent seeking permission of the court to condone your absence on the hearing date.
