Expediting filing of chargesheet

Dear All,

Is there any of expediting filing of chargesheet in 498a/406/34. It has been more than 18 months since FIR was filed in June 2013 but till now IO has not filed a chargesheet .

All people named in FIR have given thier statements and there is nothing pending from our side.

Please advise.

This sould be helpful. Is there a post or something, that tells detailed procedure with approximate timelines? most importantly, what procedure police is 'suppose' to follow vs what they actually follow? (complaint->investigation->chargesheet->court)  whats happened with me is: Complaint->mediation->FIR->AB application->home visit by cops->Ab hearing pending->?? (waiting for whats the next step?). So far there is no statement taken from us.

Since the sections involved have imprisonment of 7 years , section 167[2][a][ ii], the investigation has to be completed If chage sheet is not filled in that period person in custody has right of bail, otherwise for offence punishable more than 3 years has no limit. for bail purposes within 60 days and not 90 days.

Yes, u can file a criminal misc writ petition in the concerned high court for expediting the investigation.

File an RTI. A writ of mandamus may also take a long time.

File an application to get the progress report before the Magistrate, and then if no progress taken place then you can file a writ before Hon'ble High Court.

Same here. Chargesheet not filed for sometime. Initially was some activity (Cops visiting, calling) After AB its comparatively quite and it been quite some time.

What are the cons of chargesheet getting delayed? Please advise.
