Fight for justice (manager)     18 March 2014

Ex parte order

Metropolitan Magistrate has passed ex parte interim order for monthly maintainence to be paid to child (not for mother as she is working. The petitioner/applicant (wife) was not present at time of judgement neither was her legal counsel present. Is the order still valid or can she challenge it saying that she was not present?

She is always present at all hearings, so it v surprising that no one from her side was present - any ideas why that may be teh case?

the court have power to pronounce order in the absence of parties. no illegality in the order but she has right to challenged the same before appellate court if she think to do that.
