Eviction of tenant

 

Hi Law Team,

 

It is to mention that we are the landlords and have rented a shop for pharmacy. Initially we had 3 years agreement and again we renewed for 3 more years. Now we want to vacate our tenant as the tenancy period will end by August 31st 2012.

 

 

So we have given a written notice for vacation of the property one month back and orally we told six months back. Then the tenant has sent a letter of petition of caveat and then sent one more letter telling that we have renewed the agreement six months back and then mentioned in the same letter to renew the agreement. As we have discussed with him that we have not renewed the agreement six months back, then tenant replied, he himself has renewed for drug license renewal and has done forgery of the signature.

 

 

1. Now what is the procedure to vacate the tenant as we want the property for own purpose. We want to deal the tenant with respect and professionally with out any other illegal and unprofessional ways.

2. Can eviction order help in this regard? If so, what is the procedure.

a) so what will the court fees if we want to file a suit?

 

b) Apart from court fees any deposit needs to be paid based on our rent?

a. court fee will be computed on the basis of total rent of 12 moths.

b. no.

Dear Team please guide people with proper terms also.

 

Dear Khan what ever many be the case if it goes to Civil then three years to five years you have to wait for evicting the tenant.

Civil court dates are like 1 date in 3 to 5 months and silly counter by opposition party and they will pull the case for 5 to 6 years and if he applied kevat then you should literally be back of tenanat atlast requesting him to what ever terms he put.

Owners are just dummy who stuggle complete life to make assets and tenenat are like owner with no hard out put.
