Esma against govt. servant by citizen or company

We have recently come across a Commissioner who is not attending to complaints regarding street lights for months intentionally. Can a citizen or a company which is suffering due to his action initiate or invoke action against him under ESMA Act? If yes, what is the procedure?

The Commissioner is a Government  employ, Company, Citizen can not use ESMA  Act,  against Government Employee only the Government  has power to use . Your street lights were not lit up for months you complain to concern officer. You may go the consumer  Forum.

My question is whether we can approach High Court to legally issue order to Govt. to initiate action against the Commissioner under ESMA.
