Esi applicability

ESI & Employees compensation act are two different acts. Is it that where ESI applicable WC is not applicable. Is there any mention in the statutes that WC is applicable where ESI is not applicable. Can a beneficiary claim benefit under both the schemes ?

Hi Radhakrishnan

Both ESI and EC is different.   As far as EC is concerned, we can get the claim if any unforseen happens.  But ESI we can get the medical benefit.  Compared with EC, ESI is more beneficial.  For labour both ESI and EC has to be complied.   In remote areas where there is no ESI despensary, we can comply with EC alone.

Hi Mary

It is clear that ESI and EC are different. My point is where ESI is applicable (the area is a covered area for ESI) EC is not required becuase the disability benefits are taken care under ESI. But where ESI is not applicable, employers are taking WC policy which gives benefit only in case of disability and does not provide any medical benefits unlike ESI. In that eventuality, whether employers are under any obligatoin to have workmen;s compensation policies loaded with medical extension benefits as well.
