We are living in an era of commissions and Tribunals apart from the High Courts/Civil Courts and Criminal Courts etc. The problems are that many such Commissions like the Public Service Commission etc are established under the various statues and functions according to those Statues. Unfortunately some such Commissions or Tribunals functioning under those Acts are pure simple executive machinery from top to bottm but with mask or Exclusive Clause without any judiciasl element. Can their acts be excluded from judicial scrutiny as per the Exclusion Clause?
