Eligibility for Prorata pension

I HAD WORKED IN CISF ( MINISTRY OF HOME AFFAIRS) FOR 12 YEARS AND TOOK TECHNICAL RESIGINATION AND JOINED IN NUCLEAR FUEL COMPLEX (DAE) FOR TWO YEARS AND RESIGNED FROM SERVICE. I HAD DONE TOTAL 14 YEARS OF SERVICE IN CENTRAL GOVT. I NEED GUIDENCE WHETHER I AM ELIGIBLE FOR PRORATA PENSION AND GRATUITY.

Having put in service of more than 10 years in CISF, you were eligible for prorata pension and gratuity from the CISF, as of final settlement, or to get your pension liabilities transferred from CISF to the DAE. If you had not got your pensionary liability transferred or the the CISF has not already transferred that to DAE even on your technical resignation, you could claim the pension benefits from the CISF. But if the pension liabilities already stood transferred to the present department, you lose the benefits of pension having resigned from service. On resignation, no pensionary benefits are admissible to any Government employee.

SIR,

I HAD WORKED IN CISF(MHA) FOR 12 YEARS AND RESIGNED IN 1999. NO GRATUITY/PENSION RECEIVED. WHEN ASKED DENIED DUE TO NON ELIGIBILITY - NON TECHNICAL RESIGNATION. AS PER THE GRATUITY RULES MY SERVICE PERMITS TO CLAIM. SHALL I GO FOR A LEGAL PROCEDURE?
