Electricity disconnection due to non payment of maintenance

Dear Qualified Members,

We are a society based in Greater Noida, owners here have purchased flats from the Builder and the proerty is being maintained by another agency appointed by the builder.

We were earlier paying the Maintenence & Electricity charges to the builder directly which is now being collected by the maintenence agency for past few months.

Some old residents have disputes with the builder and some claim that all the maintenence charges were already paid to the builder directly which the Agency doesn't show in books and harras residents in order to pay the money or they'll disconnect the electricity.

- Can the builder or the Maintenence Agency or the RWA team threaten and disconnect Electricity/Power Supply to any house if the resident is paying Electricity Bills on Time and is also paying the Maintehence Charges (Later than the Disputed period)?

- Does the U.P. State Govt. Allow them to harass and threaten residents/owners in order to recover money especially when the Electricity bills are payed by the residents way before the due date?

Can any of them (Builder/Maintenence Agency or RWA) have the right to diconnect Power Supply of any house in Uttar Pradesh as per the U.P. Apartment ACT?

You Registered society members can take the control of the situation by passing a resolution to change the agency or that the committee members shall maintain the society and terminate the services of that agency.

Incase, electricity bill or water charges are not paid for two months or so then only the concerned utility service provider shall have the right to take appropriate action against such consumer/s and no other agency can claim such rights.Failing which, such flat owners can lodge police complaint against the maintainence agency for disconnecting the electricity connection withou any authority.

Dear Mr. Dalmia,

Appreciate your help and response.

The RWA is not interested in the matter and are keeping mum saying that we can't intervene since this is between the Owner and Agency/Builder, hence they are useless.

Also, the electricity is Private here in Greater Noida (From NPCL - Noida Power Company Limited) who have laid down the connection till the society gate and then the builder distributed power to individual flats by fixing their own meters and charging us towards the one time Meter Charges and Monthly Energy Consumption + Fixed Charges in turn paying NPCL commulatively.

Do they still have the right to disconnect electricity?
