Educational bond

Hi.

I am NEWLY QUALIFIED mbbs DOCTOR. I had gotten my admission under christian category of entrancxe examination. Though the prospectus had mentioned of a 2 yrs service agreement, no other details wewre mentioned. diuring my councelling session, i was asked to sign a bond stating that i would do 2 yrs bond in anyy place decided by the management. Also thye amount to be paid for releasing the bond was 20 lakh rs. For my admission i did sign  my bond. After my first year, my fee was increased from 1 lakh tgo 1.75 lakh. due to this i received rs 30000 as scholarship and tiotal of 50000 rs as interest free loan. Now I have finisjhed my studies and sytarted my bond. What i am being paid is rs 13000 per month, which i feel is too less as any mbbs doctor would be paid at least 20000- 25000. Also my work hours are not fixed and sometimes, well most times, I have to work 24 hrs. Due yto some personal problems, i have to leave my bond now... Can i do it without making the payment??

I was told by a lawyer that since i took the loan and scholarship, i have no choice but to finish my bond or pay up. Is this the olnly option available?

Can i sue the institute in court of law( The agreement said any disputes will only be settled in Ludhiana sessions). can i sue them in high court of chandigarh? also would the verdict take a long time?

 

Is there any ooption where i can leave bond stating that the salary is too less...?

It is felt that the medical college has not paid your fees it has rather sanctioned a loan which you are supposed to repay.

It is surprising that scholarship which is paid to meritorious or deserving candidates as per rules of scholarship is being treated as a ground for creating bond.

The amount of bond is not reasonable. Flaunting bond employee is being compelled to accept a salary which is peanuts.

You may study the norms set by regulators like MCI for salary. Ludhiana is a big city. You may obtain second opinion and show all documents including bond, appointment letter, scholrship rules, loan application, loan sanction letter, loan rules,and any other record to a competent and experienced service lawyer/labor consultant, and give inputs in person. Your lawyer may find relief for you.
