Dv ,interim maintenance

Wife has filed in dv a new application asking for interim maintenance ..main petition she has not asked for it  but has stated that she is entitled for permanent maintenance (amount not specified)..has also stated that the court should allow her to amend ,alter or modify her petition during the proceedings in wake of justice ..her lawyer argued that she is so very mentally disturbed because of all cruelties done by her husband that she cannot work properly,is a medico so can't risk the patients life ..she has also asked for residence right in shared household which is pending ...can she submit an application for interim maintenance now ?

yes she can file for interim maintenance,2, when she is going for amendment in her plaint,u r counsel can object and raise ur points,3, if u r living in own house she is eligible for shared household, or if ur residing  in ancestor property, then also she is eligible for this..3, she is educated and she has the capacity to earn in remaining part of life so argue this case on its merits and try to avoid the quantum of maintenance at the max possible.
