At the time of accident license of driver was pending for renewal in accordance to proviso to s. 15 (4). Held that, driver was holding deemed license . Insurance company can not escape its liability. Further held that words effective license used in s. 3 can not be imported for s. 149(2) . Words “duly licensed used in s. 149(2) are used in past tense – National Insurance Co. Ltd. v. Mahadev Rawat, 2010 (4) AWC 3702,(Allahabad HC), Decided on 16/02/2010
