Does the elder son with his younger sister hasrights in fathers immovable asset after his death.

Dear Sir,

My father's elder brother expired on last month in Coimbatore, TamilNadu leaving behind his wife, a son (54 years) and a daughter (52 years). His son has a wife (46 years in India) and a only boy (12 years currently in abroad with his father). Younger sister is married and separated from the husband and having twin daughters of (26 years), living in gulf country and possess a permanent job.

His father's immovable asset worth of 2.5 Crores is written on his younger sister name without the consent of him where he is currently living in abroad with his only son having in a very worst condition in abroad without job and proper lifestyle and not able to travel back (Travel Ban) to India because of some legal issues with the past company owner for non payment of the 24 months pending salaries.

His wife is residing in the neighbouring state with her parents unhealthy condition and she is taking care of her parents. His Mother is completely under the control of his younger sister and threatened very badly.

Now, we don't know how to bring him back to India and how to initiate a legal case against his departed father.

I humbly request you to guide us as soon as possible with legal rights to both the childrens under the India legal law.

Thank you very much for your time and consideration.
