Divorce Ground

Dear All,

 

I am planning to file divorce and I have two grounds applicable to me:

  1. Desertion: Wife left home 2 years back and did not join till date.
  2. Cruelty: Wife filed 498A on husband and his relatives saying all the family members harassed her though husband relatives never (even single day) did not live with her.

I am thinking to file divorce on the ground desertion, considering it is easy to prove in court because we are living seperately and wife also admitted in CrPC-125 case.

 

Does my thinking is correct ...

Does it true that getting divorce on the ground dersertion is easy ...?

Which ground is easy to prove and get divorce easily among desertion and cruelty...?

Nothing is easy,u have to prove u r case once u file it,burden lies on u,not all withdrawl fron company of spouse are not 'DESERTION',mere filing of a case u/s.498A doesnot amount to(of coz false case can) get ready for another round of litigation Good luck

If you have sufficient proofs of Desertion as well as cruelity then apply divorce on both of the grounds (Desertion + Cruelity)
