Divorce by mutual consent-Basic requirements

 

Hi alls,

plz let m know about pre-requirements and documents nedded for th divorce by mutual consent.

-my brother got married 2yrs+10 months before.   under HMA

-due to the affair from another person of bride, she went to her home side and did not returned yet. during this period we have tried our best to solve the matter but nothing happened.

-now the situation is that the bride side is demanding  a huge amount towards divorce.

-no legal action has been taken from either of the side.

-Being  afraid of 498A or other problems we have decided to give that amount to them and to take divorce by mutual consent.

-my brother is a central govt. employee.

-Plz let me know that what are the pre requirements, documents or proforma/procedure/duration of that?

plz help me and letme know that howcanwe proceed safely?

 Along with the petition you'll have to attach the marriage certificate. The husband and the wife both are petitioners in such a case. The court will give a date after 6 months. After the said period if both parties are willing for divorce then the court grants divorce.
