Divorce

Sir, I marry in the year 1999,applied divorce in the year 2005 court issued ex party divorce in the year 2006.from 2009 to till date me and my divorced wife again living together and had one female child. Now we have more differences and we can not live together. Now we are decided to separate. Please let me know how to separate legally. Already ex party divorce happened in the year 2006,same is valid or new mutually agreed fresh petition needs to apply! Thanks, Jagan

Divorce decree is valid throughout your lifetime unless challenged and set aside by the court. The trouble for you will not be divorce decree for getting out of the livein relationship you continued even after the divorce but the act of continuing relationship with your ex-wife without her being informed of exitance of decree of divorce that dissolved your marriage that happened in 2006. After 10 years if you move out, she will lodge criminal complaint against you for cheating and rape for all that happened between both of you in the last 10 years, be careful before you take any step forward now.

Sir, Thanks for valuable reply. Please let me know how to separate smoothly. She asked me to register house in the name of female child.I am ready to register property to female child.let me suggest which is the best option. Again applied for divorce or written agreement sufficient. Thanks, Jagan

you are divorced. she is not your wife. she can only claim maintenance.

but did you live togather after divorce after convincing her that you are husband and wife?
