Distribution of surplus funds by trade union

Due to fall in membership strength, trade union of a merchant company is surrendering registration. There is an huge surplus fund. Can it be distributed among existing members and ex members, who are now promoted to Mgt cadre. Do not want to lose this fund in favour of forfeiture.

Kindly guide.

Call general body meeting and take consent of all  members and then proceed.

Any suggestion depends upon the law under which the Trade Union is registered.;

Under Trade Union Act 1926 by Registrar, West Bengal. Earlier membership strength was 400 plus. Now only two. But huge surplus of Rs.5 Lakhs. Would like to distribute among existing 2 members and 15 ex members, who are still with company but upgraded to management cadre
