Disentitlement from Fundamental Rights


Should there be an amendment in the constitution to the effect that : a person who violates the fundamental

duties and propagates disrespect for the constitution,  is not entitled to the rights under the constitution

including fundamental rights?

Sir, i completely agree wth your views and i would love to that kind of amendment but in practicality that can not take effect.

not much practical.

failure to fundamental duties,- person may be punished in diffrent way, not by depriving him from his fundamental and constitutional right - these are human rights also.

Fundamental rights are most inalienable rights which cannot be taken away.

What happened to these inalienable rights during the Emergency?

Emergency is an exceptional situation, I am talking about general situation. In general, the FR are inalienable rights. Some of them are even available to non citizens, like Article 21 which guarantees right to life and personal liberty.
